If I read it right the 433.800 frequentie is only a spare to be used in 
countries that do not alow aprs on 144.800, the countries effected are 
very sparesly populated so the remote devices wil most likely not form a 
problem.
Building a tracker with just 10mW does not sound like optimal, you would 
at least need a driver to get it op to a few watts
