This is not true. Once you purchase the DVSI vocoder chip you can do anything you please with it. You can use it in a commerical radio, a telephone, a communications satellite, a ham radio, etc. Owning an AMBE vocoder is like buying a font for your word processor. You can't copy it and resell it, but you can purchase it and you can use it anyway you want. Microsoft can't sell you a font, then tell you it can't be used to write a ham radio club newsletter.
